Malloy overlay bylaw approved

An overlay plan for the Malloy landing subdivision has been approved.

A public hearing for Land Use Bylaw Amendment 903-P-10-24 – Establishment of Malloy Landing Residential R2 Overlay Plan was held during council’s regular Nov. 18 meeting. The amendment would allow for an overlay plan for the area within boundaries of the NW Area Structure Plan, that would allow for an alternative regulation of multi-family development, which was established by Land Use Bylaw Amendment 872-P-05-23 and subsequent amendments. The developer of the Malloy Landing subdivision, SHIFT Real Estate, is preparing to move forward with developing the multi-family portion of the subdivision, but wishes for alternatives to the Residential Multifamily R2 zoning regulations there so that development can more closely align to expectations from major multifamily builders in the region.

“Specifically, the developer is requesting the establishment of a unique set of rules over and above those rules currently established within the R2 zoning, which would apply only within the Malloy Landing – which similar in nature to the existing Downtown Overlay, which exists within the C1 district of the existing Land Use Bylaw,” said Cam Mills, director of growth and development for the town. “The adjustment to the zoning is largely due, is being argued or is arguably somewhat out of date – the existing R2 zoning – relative to current market trends and adjustments to housing affordability that have shifted substantially in the past decade. So similar adjustments were made within the outline plan to accommodate changes to the R1-A zoning allowing for lots more in line with existing market demand.”

First reading of the bylaw took place during council’s regular Oct. 28 meeting. As of the publication of the report, Mills said no correspondence from the public was received in regard to the bylaw. The proponent did provide a letter outlining their reasoning for the proposed changes, including visual examples of similar units that are currently selling in Lethbridge.

Following the public hearing, council unanimously passed second and third and final reading of Land Use Bylaw Amendment 903-P-10-24 – Establishment of Malloy Landing Residential R2 Overlay Plan.
